                   AN ORDINANCE CLOSING AND ABANDONING ALLEYS
                   LOCATED NORTHEAST FROM ELMENDORF STREET,
                   NORTHWEST AND SOUTHEAST OF NORTH HAWTHORNE
                   STREET, MORE PARTICULARLY DESCRIBED HEREIN,
                   UPON CERTAIN CONDITIONS.

              	   SECTION 1.  BE IT ORDAINED BY THE CITY COUNCIL OF THE
         CITY OF CHATTANOOGA, TENNESSEE, That there be and is hereby 
closed
         and abandoned alleys located northeast from Elmendorf Street,
         northwest and southeast of North Hawthorne Street, more
         particularly described herein, and as shown on plat attached
         hereto and made a part hereof by reference:
               
                A 20 foot wide unopened alleyway beginning on the
                northeast line of Elmendorf Street 145 feet
                northwest of the intersection of the northeast line
                of Elmendorf Street with the northwest line of
                North Hawthorne Street, and extending northeast 245
                feet between parallel lines to the southwest line
                of Lots 15 and 16, Block 41, East Chattanooga
                Middle Section, as shown by plat of record in plat
                book 3, page 21, R.O.H.C.  Said alleyway separates
                Lots 1-9 from Lots 22-30, Block 41, said East
                Chattanooga Middle Section.
               
                A 20 foot wide alleyway beginning on the northeast
                line of Elmendorf Street 145 feet southeast of the
                intersection of the northeast line of Elmendorf
                Street with the southeast line of North Hawthorne
                Street, and extending northeast 225 feet between
                parallel lines to the southwest line of another 20
                foot alleyway.  Said alleyway to be abandoned
                separates Lots 1-9 from Lots 22-30, Block 4, East
                Chattanooga Middle Section, as shown by plat of
                record in Plat Book 3, Page 21, R.O.H.C.
               
               
              	   SECTION 2.  BE IT FURTHER ORDAINED, That this closure
         and abandonment is made subject to the following conditions:
                1. Resubdivision of the property to prevent Lots 9
                   and 10, Block 41, East Chattanooga Middle
                   Section, from being landlocked.
               
              	   SECTION 3.  BE IT FURTHER ORDAINED, That this
         Ordinance shall take effect two weeks from and after its 
passage
         as provided by law, provided, however, that this Ordinance 
shall
         not be operative until completion of the condition in Section 2 

         above.
